Present for the Conservation Commission and attending the meeting were: Pam Goff, Sandy Broyard, Caitlin Jones, Dick Smith, Wes Cottle, Donald Poole and Chuck Hodgkinson. Gary Maynard, Emily Bramhall, Carlos Montoya and Reid Silva also attended. Richard Steves was absent.
The meeting came to order at 12:30 PM. Ms. Goff was appointed as acting Chair. Caitlin Jones and Wes Cottle were appointed as voting members for the day’s agenda. The site visits for today’s meeting were made on September 20.
NOI SE 12 – 638; GEORGE SOURATI FOR DAN AND TARA GOLEMAN; 15 Hammett Rd.; AP 8-50.1: Chuck H. informed the Commission that Mr. Sourati requests the hearing be rescheduled for November 16, 2011 @ 12:30 PM. A motion was made to accept the request. The motion was seconded and unanimously approved with six in favor. The application is to install a six-foot wide horse path through an isolated wetland and install a buried utility line under the proposed horse path through the wetland.
CARLOS MONTOYA FOR ENFORCEMENT ORDER; 8 Greenhouse Lane; AP 33-30: Chuck H. informed the Commission that the $100 fine payment has been received from the property owner. Mr. Montoya reviewed a plan that responds to the Enforcement Order requirements. A written narrative dated 9/21/11 accompanied the site plan. The Enforcement Order mandated the following: 1. Provide a field mowing plan that establishes a no-cut buffer along the stream’s edges. 2. Provide a restoration plan of native vegetation that re-establishes a no-cut buffer from the top of the coastal bank. 3. Provide a care and maintenance plan (specify any organic or other fertilizers if any) for
the newly planted lawn outside the no cut buffer.
Mr. Montoya outlined a plan with added switch grass for “Meadow A” and an area labeled “Meadow B” on a site plan. After much discussion the following approvals were moved, seconded and passed unanimously by the Commission with six in favor. In discussion the Commission commented on the owner’s impressive coastal bank stabilization project and results.
- The planting plan and area for “Meadow A” are approved as presented. The inner edge of Meadow A that borders the lawn area shall be permanently marked with rocks of some sort to define the limit of regular grass mowing versus the heath land meadow.
- The area defined as “Meadow B” is a different habitat than the switch grass meadow. This area marked as Meadow B shall not have any additional planting and will be allowed to grow back to its previous state of bramble and grape. The owner is allowed to maintain the height of this brush after it returns to a minimum height of three feet above the ground. The owner or his agent shall inform the Conservation Agent of the pruning plan before work begins.
- There shall be no permanent irrigation system installed on the property. It is understood that a temporary above-ground system may be needed to help establish the lawn and heath land planting areas for the first two seasons.
- A revised site plan shall be provided that accurately reflects these agreements.
FOUR CERTIFICATES OF COMPLIANCE FOR 9 AZALEA NOMINEE TRUST; AP 29-8: The observations made at the previous day’s site visit were discussed.
- Amended SE 12 – 531: Original plan to relocate dwellings. A motion was made to declare this project in full compliance. The motion was seconded and unanimously approved with six in favor.
- SE 12 – 589: Reduce the amount of decking by 653 sq. ft. and add 631 sq. ft. of habitable living space in the buffer zone; add a limit of mowing to the plan. A motion was made to declare this project in full compliance with the following on-going condition: The limit of mowing on the east sides of the dwellings shall not go beyond the staked areas as shown on the site plan dated 6/17/10. The motion was seconded and unanimously approved with six in favor.
- SE 12 – 615: Beach stairway. A motion was made to declare this project in full compliance provided all of the special conditions outlined in the Order of Conditions dated 10/20/10 remain in place as on-going conditions. The motion was seconded. In discussion the Commission mentioned this Certificate should not be released until the Map and Lot numbers are permanently labeled on the lower sections of the stairway. The motion passed unanimously with six in favor.
- SE 12 – 622: New water line a portion of which went through a wetland. A motion was made to declare this project in full compliance. The motion was seconded and unanimously approved with six in favor.
ADMINISTRATION:
The September 7 Meeting Minutes were approved as presented by consensus.
The Chapter 91 License application for Barbara Day’s walkway and pier was reviewed and signed: SE 12 - 632; AP 33-66.
